Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Amon AI platform operated by Amon AI ("we", "our", or "us") at amonai.com.au. By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Description

Amon AI is a business automation platform that provides AI-powered tools including, but not limited to:

• AI-generated email and SMS replies, proposals, and quotes.
• Lead management and follow-up automation.
• Social media content creation and scheduling.
• Client intake forms and invoice generation.
• Integration with third-party platforms including Gmail, Meta, Twilio, and OpenAI.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable to you or any third party for any such changes.

2. Account Registration

To use Amon AI you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at jul@amonbusinessai.com if you suspect unauthorised access to your account.

You must be at least 18 years old and legally capable of entering into a binding agreement to use this service. Accounts registered on behalf of a business represent that they have authority to bind that business to these Terms.

3. User Responsibilities

By using Amon AI, you agree to:

• Use the platform only for lawful business purposes.
• Comply with all applicable laws, including anti-spam, consumer protection, and data privacy regulations (e.g. CAN-SPAM, TCPA, GDPR where applicable).
• Obtain all necessary consents before sending communications to your contacts via the platform.
• Not upload or transmit content that is illegal, defamatory, harassing, or infringing on third-party rights.
• Not attempt to reverse-engineer, scrape, or interfere with the platform's infrastructure or security.
• Not use the platform to generate spam, misleading content, or communications in violation of any platform's terms (including Meta, Gmail, and Twilio acceptable use policies).
• Keep your connected API keys and credentials secure and not share account access with unauthorised parties.

We reserve the right to suspend or terminate accounts that violate these responsibilities without prior notice.

4. Payment Terms

Access to Amon AI is provided on a subscription basis. By subscribing, you authorise us to charge the applicable fees to your nominated payment method on a recurring basis (monthly or annually, depending on your plan).

• All fees are stated in Australian Dollars (AUD) unless otherwise specified.
• Subscription fees are billed in advance at the start of each billing period.
• Prices may change with at least 14 days' notice. Continued use after a price change constitutes acceptance.
• We do not offer refunds for partial billing periods unless required by applicable consumer law.
• If a payment fails, access to the platform may be suspended until the outstanding balance is resolved.

5. Cancellation Policy

You may cancel your subscription at any time from your account settings or by contacting us at jul@amonbusinessai.com.

• Cancellation takes effect at the end of the current billing period. You will retain access to the platform until that date.
• No refunds are issued for the remaining days of a billing period after cancellation, except where required by law.
• Upon cancellation, your data will be retained for 30 days before deletion, giving you time to export any records you need.
• We reserve the right to cancel or suspend accounts that violate these Terms, without refund.

6. Intellectual Property

All software, design, trademarks, logos, and content that form the Amon AI platform are the exclusive property of Amon AI or its licensors. Nothing in these Terms grants you ownership of any platform intellectual property.

You retain ownership of the data and content you upload to the platform ("Your Content"). By using the platform, you grant Amon AI a limited, non-exclusive licence to process and store Your Content solely for the purpose of delivering the service to you.

AI-generated outputs produced by the platform on your behalf (e.g. drafted emails, proposals, captions) are provided for your use. We make no warranty that such outputs are original or free from third-party intellectual property claims, and you are responsible for reviewing content before sending or publishing it.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Amon AI and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to:

• Loss of revenue, profits, or business opportunities.
• Loss or corruption of data.
• Errors or omissions in AI-generated content.
• Interruptions to third-party integrations (Gmail, Meta, Twilio, OpenAI, etc.).
• Unauthorised access to your account resulting from your failure to secure your credentials.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to Amon AI in the three (3) months immediately preceding the event giving rise to the claim.

The platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any purpose.

8. Third-Party Services

Amon AI integrates with third-party platforms (Google, OpenAI, Meta, Twilio, and others). These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or actions of third-party services. Your use of connected integrations is subject to those providers' terms.

9. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, notify you by email. Continued use of the platform after the effective date of updated Terms constitutes your acceptance.
